1. Introduction and acceptance
1.1 Welcome to My Humdum. My Humdum is a verification first matrimony platform for people who are serious about marriage. These Terms of Use and Service Agreement (the “Terms” or this “Agreement”) govern your access to and use of the My Humdum website at www.myhumdum.com, any application we may publish, and all services, features and content offered through them (together, the “Platform” and the “Services”).
1.2 The Platform is owned and operated by My Humdum Private Limited, a company incorporated under the Companies Act, 2013, having CIN U63122MH2026PTC474555 and its registered office at 6th Floor, WeWork Spectrum Tower, Building No. 11, Chincholi Bunder Road, Malad (West), Mumbai 400064, Maharashtra, India (“My Humdum”, “we”, “us” or “our”).
1.3 This Agreement is an electronic record under the Information Technology Act, 2000 and the rules made under it, and is published in compliance with Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. It is generated by a computer system and does not require any physical or digital signature.
1.4 By visiting, browsing, registering on, or using the Platform in any way, you confirm that you have read, understood and agreed to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Platform.
1.5 Your acceptance is recorded. When you register, you accept these Terms by a clear affirmative action, and we record the version you accepted, the date, the time and the IP address from which you accepted. That record is evidence of your acceptance and may be produced in any proceeding.
1.6 Your consent to the processing of your personal data is a separate act. It is given in response to a standalone consent notice presented to you during registration, which is understandable independently of these Terms, and it is recorded separately. Accepting these Terms is not, by itself, consent to the processing of your personal data, and consent to processing is not, by itself, acceptance of these Terms.
1.7 The following documents form part of this Agreement and are incorporated by reference:
- the Privacy Policy, available at www.myhumdum.com/privacy;
- the Cookie Policy, available at www.myhumdum.com/cookies;
- Annexure A, the Cancellation and Refund Policy;
- Annexure B, the Community Guidelines;
- the Safety Guidelines, available at www.myhumdum.com/safety;
- the Disclaimer, available at www.myhumdum.com/disclaimer;
- the Service Delivery Policy, available at www.myhumdum.com/delivery; and
- any additional terms shown to you at the point of purchasing a specific membership or feature.
1.8 Where there is a conflict, the additional terms for a specific membership prevail over these Terms for that membership only, the Privacy Policy prevails on any question of personal data, and these Terms prevail over all other documents.

3. What My Humdum is, and what it is not
3.1 My Humdum is an introduction and matchmaking facilitation platform. We verify the people on it, we help you describe who you are and who you are looking for, and we introduce you to a small number of people who fit both sides’ preferences. What happens after the introduction is between you and the other person.
3.2 My Humdum is not a marriage bureau, a wedding planner, an investigation or background screening agency, a legal adviser, a financial adviser, a medical or genetic adviser, an astrologer, a counsellor, or a party to any relationship or marriage formed through the Platform.
3.3 We do not promise, guarantee or warrant that you will find a partner, receive any particular number of introductions, receive a reply to any request, or marry. Matching depends on the people who are on the Platform at a given time and on their own choices.
3.4 We measure our success by members leaving the Platform married, not by the time they spend on it. We do not design the Platform to keep you engaged, and we do not use countdowns, streaks, artificial urgency or sales pressure.
3.5 The Platform is currently available as a web application and is intended for individuals seeking a lawful matrimonial alliance in India. If you access the Platform from outside India, you do so on your own initiative and you are responsible for complying with the laws that apply to you.
3.6 Access to the Platform and the creation of a profile are free. Certain features are available only on paid Memberships, as described on our pricing page.
3.7 Our full disclaimers are set out in clause 26 and in the Disclaimer at www.myhumdum.com/disclaimer.
4. Eligibility
4.1 To register as a Member you must be competent to contract under the Indian Contract Act, 1872.
4.2 You must be at least 21 years of age if you are a man, and at least 18 years of age if you are a woman. This reflects the minimum legal age of marriage under the Prohibition of Child Marriage Act, 2006 and the personal law applicable to you. We do not permit anyone below the applicable age to register, and we verify age against a government issued identity document.
4.3 You must be legally free to marry. This means you are unmarried, or you are a widow or widower, or your marriage has been dissolved by a decree of divorce that has taken effect. If divorce or annulment proceedings are pending, or if you are judicially separated but not divorced, you are not eligible to register until the decree takes effect. You must be able to produce the decree if we ask.
4.4 You must be registering with the genuine intention of entering into marriage. The Platform must not be used for casual dating, companionship, extramarital contact, entertainment, research, recruitment, lead generation, promotion, or any other purpose.
4.5 You must be a natural person registering for yourself, or a Profile Manager acting under clause 5.4. Companies, firms, agencies, marriage bureaus, brokers, matchmakers acting for a fee, and any other body corporate or unincorporated entity may not register or use the Services in any capacity.
4.6 You confirm that you are not subject to any order of a court, tribunal or authority that restricts your ability to marry, and that you have not been convicted of any offence involving sexual violence, offences against children, domestic violence, dowry, stalking, human trafficking or fraud. We may ask you to declare this at registration.
4.7 Each individual may hold only one profile. Where we identify duplicate profiles for the same individual, we may close all but one, with notice, and without refund of any fees paid on the duplicates.
4.8 We reserve the right of admission. We may decline an application or close a Membership where a person does not meet these criteria or where, acting reasonably, we believe admitting or retaining them would put other Members at risk. Where we decline an application at onboarding after a payment has been taken, we refund that payment in full under Annexure A.
5. Registration, profile information and Managed Profiles
5.1 You must provide information that is true, accurate, current and complete, and you must keep it updated. Your profile is the basis on which another person decides whether to meet you, so accuracy here is not a formality.
5.2 In particular, you must not misstate your age, gender, marital status, whether you have children and whether they live with you, your current city, your highest completed education, your current employment and employer, your income band, your citizenship or residency status, or any fact you are required by law to disclose to a prospective spouse.
5.3 We do not ask for, and you are not required to disclose, your HIV status. Consistent with the Human Immunodeficiency Virus and Acquired Immune Deficiency Syndrome (Prevention and Control) Act, 2017, we will not require such disclosure and we will not act adversely on it if it is volunteered.
5.4 Managed Profiles. A parent, sibling, guardian, relative or close friend may create and manage a profile on behalf of an eligible adult, provided that:
- the Member has given informed, written consent, which the Profile Manager must produce to us on request;
- the profile clearly displays that it is managed for the Member;
- the Member may take direct control of, or close, the profile at any time, and their instruction overrides the Profile Manager’s;
- the Profile Manager does not misrepresent themselves as the Member in messages; and
- the Member remains the person whose personal data is being processed and holds all rights in respect of that data.
5.5 Creating a profile for another person without their genuine consent is impersonation. It is an offence under applicable law, including the Bharatiya Nyaya Sanhita, 2023 and the Information Technology Act, 2000, and we will close the account and may report it.
5.6 Photographs must be recent, must be of you, and must not be obscene, misleading, digitally altered to change your appearance in a material way, generated to depict a person who is not you, watermarked with contact details, or contain other identifiable people without their consent.
5.7 We may decline, remove or ask you to change any profile content that breaches these Terms. Where we do, we will tell you what the problem is and give you a chance to fix it, unless the content is unlawful or unsafe, in which case we may act immediately.
5.8 Complete and recently updated profiles are shown ahead of incomplete ones. This is a consequence of how matching works and is not a paid placement.
6. Verification and what our badges mean
6.1 Verification is the core of this Platform. Depending on your Membership and on what you choose to display, we may ask you to complete some or all of the following: mobile number confirmation by one time password, email confirmation, government issued identity verification, a live selfie check, education verification, and employment verification.
6.2 Where a check is completed, your profile displays a badge naming the category verified. We do not display a badge for a check we have not actually performed.
6.3 What a badge does not mean. A verification badge confirms only that a specific document or check was completed. It is not a character certificate. It is not a criminal record check unless we have expressly stated that a criminal record check was performed. It is not an assurance of a person’s honesty, intentions, health, finances, family circumstances or suitability for you. You must still use your own judgement, ask your own questions, and make your own enquiries before taking any decision, including any decision to meet, to introduce families, or to marry.
6.4 We may use third party verification agencies, technology providers and sub processors to carry out these checks. By submitting documents you consent to us sharing them with such providers for that purpose only, on the terms set out in our Privacy Policy.
6.5 Identity verification and Aadhaar. We carry out identity verification through DigiLocker, where you yourself fetch and share a document, or through Aadhaar offline verification with your consent, or against a passport, driving licence, voter identity card or other accepted document. We never require Aadhaar, we never carry out online Aadhaar authentication, we never store a full Aadhaar number, and we never display an Aadhaar number to anyone. Where Aadhaar is used we store only the last four digits, the verification result and the date.
6.6 Document images are deleted as soon as the review is completed, whether the check succeeds or fails, and in no case are they retained for more than 90 days from upload. We keep the outcome of the check, not the document.
6.7 We may re verify at any time, and we may require re verification before you use particular features. If a check fails, if a document is found to be forged or altered, or if you refuse a reasonable re verification request, we may suspend or close your account. Where forgery is established, no refund is payable and we may report the matter to the police.
6.8 We take reasonable care in reviewing documents, but we are not a forensic document examiner, an investigation agency or a background screening agency. We do not accept legal responsibility for a document that is forged, altered or obtained by fraud and that passes a reasonable review, or for any statement a Member makes about themselves that we have not expressly verified.
6.9 We cannot provide the Services without processing verification information. If you do not wish this information to be processed, please do not register.
7. Account security
7.1 You are responsible for keeping your login credentials and your registered mobile number secure, and for all activity carried out through your account.
7.2 You must not share your account, sell it, transfer it, or allow anyone other than an authorised Profile Manager to use it.
7.3 Tell us immediately at security@myhumdum.com if you believe your account has been accessed without your permission. We may log you out of all devices, reset your credentials, or temporarily restrict the account to protect you and other Members.
7.4 We are not liable for loss arising from unauthorised use of your account where that use results from your failure to keep your credentials, your device or your registered mobile number secure.
8. Memberships, pricing, payments and taxes
8.1 We offer Free, Essential and Elite Memberships. What each includes, and any limits on requests, contact sharing, saved searches or daily introductions, are set out on our pricing page. A paid Membership is a one time purchase. It is not a subscription, it has no term, and it does not renew. It remains valid until you marry, until you permanently close your account, or until the account is closed under these Terms. We may add, change or withdraw features, and where a change materially reduces what you have already paid for, clause 30 applies.
8.2 All prices are in Indian Rupees. Where a launch or promotional price applies, both the list price and the price you pay are displayed together, and the price you pay is the price shown at checkout. The checkout screen states whether Goods and Services Tax is included in or added to the price shown. You are responsible for any other taxes that apply to you.
8.3 Payments are processed by third party payment gateways. We do not store your full card, bank account or UPI details. The gateway’s own terms and the rules of your bank or card issuer apply to the transaction. We are not responsible for a failure, delay or decline at the gateway or bank, although we will help you trace a payment.
8.4 There is no renewal and no standing instruction of any kind. We do not take a recurring payment, we do not hold a mandate on your card or bank account, and there is nothing for you to cancel. You pay once, and we do not charge you again.
8.5 If we change our prices, the new price applies to new purchases only. It does not change the price of a Membership you have already paid for.
8.6 Referral credits, promotional codes and complimentary periods are not transferable, cannot be exchanged for cash, may expire, and may be withdrawn where they were obtained by fraud or by abusing the referral system.
8.7 We do not sell by telephone. We will never call you to upgrade your Membership. We may call you only for identity or safety verification, to respond to a support request you raised, or where a payment or account issue requires it, and only at reasonable hours.
8.8 Allowances such as connection requests and number reveals are weekly. They reset every Monday. Unused allowances do not carry forward.
8.9 Upgrading. An Essential Member may upgrade to Elite at any time by paying the difference between the two prices shown at the time of the upgrade. There is nothing to refund and nothing to pro rate, because neither Membership runs for a period. A Member who holds Elite cannot purchase Essential, as Elite already includes everything Essential includes.
8.10 Ordering and visibility. Your daily introductions and the ordering of results are determined by fit with both sides’ stated preferences, verification status, profile completeness and recent activity. Where a Membership includes a visibility benefit, that benefit is stated plainly on our pricing page. We will not present a paid placement to another Member as though it were a compatibility match.
9. Cancellation and refunds
9.1 Our Cancellation and Refund Policy is set out in full at Annexure A and forms part of these Terms.
9.2 In summary: Membership fees are not refundable, because access to the Platform and the creation of a verified profile are free, so you are able to see what the Platform offers you before you pay anything. Refunds are made only in the specific circumstances listed at Annexure A, paragraph A3, which are principally cases where we have not delivered what you paid for.
10. Pause, closure, deletion and success
10.1 You may pause your profile at any time, for as long as you like, as often as you like. While paused, your profile is not shown to other Members and you do not receive introductions. A pause costs you nothing. Your Membership has no term and nothing runs out while you are away, so there is nothing to protect and nothing to extend.
10.2 You may close your profile at any time, whether or not you met the person through us. We will ask you once, gently, whether you found someone. You do not have to answer. We will not call you or run a retention campaign to keep you.
10.3 When you delete your account, your profile is removed from view immediately. We delete or irreversibly anonymise your personal data within 30 days, except where we are required to retain specific records by law, or where limited information must be retained to enforce a safety decision, to defend a legal claim, or to prevent a person we have removed from returning. The full retention table is in our Privacy Policy.
10.4 Sharing your success story is entirely optional and requires a separate, specific consent. You can withdraw that consent at any time and we will remove the story and any photographs from our own website and channels within 30 days. We cannot recall material that has already been printed or republished by a third party.
10.5 If a Member dies or becomes unable to manage their own affairs, an immediate family member or a person nominated by the Member under the Digital Personal Data Protection Act, 2023 may write to support@myhumdum.com with proof of relationship or nomination and, where applicable, a death certificate, and we will close the profile. We will not disclose the contents of the account except as required by law.
11. How matching works
11.1 Your daily introductions, your match list, and the ordering of search results are produced by automated systems using the information you and other Members have provided, the preferences you have set, the preferences the other Member has set, verification status, profile completeness and recent activity. Introductions are suggestions for your own consideration. They are not advice, endorsement or a recommendation by us.
11.2 Match Score. Where your Membership includes it, and where both profiles contain enough information for the calculation to be meaningful, we may show a compatibility indication. The Match Score is an internal estimate produced from stated preferences and profile data. It does not measure attraction, character or the likelihood of a successful marriage, and it must not be treated as a substitute for meeting a person and forming your own view. Where the conditions for display are not met, no score is shown.
11.3 Kundali. Guna milan indications are shown only where both Members have separately opted in. They are provided for cultural and informational interest. We make no representation that astrological matching predicts anything about a relationship, we do not present any result as a warning, and no Member is required to opt in.
11.4 Community and caste fields are optional. We do not require them to register, we do not use them for advertising or targeting, and we do not present them as a measure of a person’s worth. If you choose to use them as a filter, that is your decision and your responsibility.
11.5 Active profiles only. Daily introductions are drawn only from Members who have been active in the last seven days. Profiles inactive for more than 30 days are not shown anywhere on the Platform. Activity is displayed at day level. We do not show live presence indicators.
11.6 The number of daily introductions associated with a Membership is a target that depends on the pool of eligible Members at that time. On a given day there may be fewer, or none, if no one meets both sides’ stated requirements. This is not a breach of these Terms.
11.7 We may change, tune or replace how matching works at any time in order to improve it. Any visibility benefit attached to a Membership is disclosed on our pricing page in accordance with clause 8.9.
12. Privacy, control and contact sharing
12.1 Our Privacy Policy explains what we collect, why, how long we keep it, who we share it with and what rights you have. It forms part of this Agreement.
12.2 Photo visibility. You control who can see your photographs. You may restrict them to Members you have connected with. We never blur a photograph as a teaser to make you pay.
12.3 Call window. You may set the hours during which you prefer to receive calls, and this is shown to Members you connect with. It is a request, and Members are expected to honour it.
12.4 Phone numbers are shared on your terms. Your number is never shown automatically. You choose who may reveal it on your profile: paying Members, or only Members whose request you have accepted. Each paying Member has a small daily limit on the contact details they may reveal, which depends on their Membership, and a paid Membership does not entitle anyone to a number your settings do not allow. You can change your choice at any time from your privacy settings, and the change applies from that moment. We cannot recover a number another person has already seen, saved or written down.
12.5 Blocking works one way. The person you block is not told, and will not see you or be shown to you again. We do not, and will not, offer any feature that tells a Member who has blocked them.
12.6 You must not screenshot, screen record, download, copy, index, scrape or republish another Member’s photographs, profile details, messages or Community posts. Sharing another Member’s photographs or details outside the Platform without their consent is a serious breach of these Terms and may be an offence. This is a rule we enforce on report; it is not a technical impossibility, and we cannot guarantee that another person will obey it.
12.7 Messages. We do not routinely read private messages. We use automated checks to detect contact details in Community posts, and we review messages and posts that are reported to us. Messages are retained while your account is active and are deleted within 180 days after your account is closed, except where they must be preserved for an investigation, a grievance, a regulatory request or a legal claim.
12.8 Do not record a voice or video call with another Member without their knowledge and consent.
13. How we expect Members to behave
13.1 Be honest. Describe yourself as you are, including the parts that are harder to write.
13.2 Respond, or pass. Silence is unkind. A gentle pass, with a reason if you can give one, is always better than leaving someone waiting.
13.3 Respect a pass. If someone passes on you, do not contact them again through another profile, through the Community, or off the Platform.
13.4 Respect a not yet. If someone does not want to share a number, meet, or introduce families, do not press.
13.5 Do not ask for money, gifts, loans, investments or financial help, and do not offer them. Genuine Members do not ask for money.
13.6 Meet safely. Meet in a public place, tell a family member or friend where you are going, arrange your own transport, and video call before meeting in person. Our Safety Guidelines say more.
13.7 Close your profile when you find someone, whether or not you found them here. Leaving a dead profile up wastes another person’s hope.
13.8 Treat our team with the same respect you would expect. Abuse of our staff will result in your account being closed.
14. Prohibited conduct and Content
14.1 You must not do, or attempt to do, any of the following on or through the Platform. This list is illustrative and not exhaustive.
Identity and integrity
- Impersonate any person, or create a profile for another person without their genuine consent.
- Use photographs of another person, stock photographs, or images generated to depict someone who is not you.
- Hold more than one profile, or create a new profile after we have closed your account.
- Provide false, forged or altered identity, education, employment, income or marital status documents.
- Conceal a subsisting marriage, a pending divorce, or a court order restricting your ability to marry.
Commercial and unlawful use
- Operate as a marriage bureau, broker, agent or matchmaker for a fee.
- Advertise, solicit or promote any product, service, business, event, job, investment, cryptocurrency, trading scheme, loan, chain scheme or multi level marketing plan.
- Collect, harvest, scrape or store data about Members, whether manually or using bots, crawlers, scripts or any automated means.
- Use the Platform or its Content to train, fine tune or evaluate any machine learning or automated decision system.
- Post links to any other matrimonial or dating platform, or to any site that competes with us.
- Use the Platform in a way that breaches any applicable law, including laws on data protection, obscenity, defamation, gambling, foreign exchange or intellectual property.
Safety and dignity
- Harass, stalk, threaten, intimidate, defame, humiliate or repeatedly contact any Member who has passed or blocked you.
- Send, request or solicit sexual content, nudity, or sexually suggestive material, or make sexual advances.
- Post or send content that promotes hatred or discrimination on the basis of religion, caste, region, language, disability, gender, gender identity, sexual orientation, appearance, occupation or health status.
- Body shame, comment on skin colour, or rate a Member’s appearance.
- Publish another person’s private information, including their address, workplace location, phone number, family details or photographs, without consent.
- Ask for, or attempt to obtain, one time passwords, banking credentials, card details, Aadhaar numbers or passwords.
- Ask another Member for money, an emergency transfer, a parcel or customs payment, a loan, or a financial investment of any kind.
- Use the Platform for casual dating, an extramarital relationship, or any purpose other than seeking marriage.
Platform integrity
- Interfere with, disrupt, probe, scan or test the security of the Platform, or circumvent any access control, rate limit or tier restriction.
- Reverse engineer, decompile or attempt to derive the source code or matching methodology of the Platform.
- Introduce malware, or use the Platform to distribute spam, chain messages or unsolicited bulk communications.
- Misrepresent an affiliation with My Humdum, or use our name, marks or design to suggest endorsement.
14.2 We may act on a breach of this clause without prior notice where the breach involves safety, fraud, unlawful content, or a risk to other Members.
15. Dowry: zero tolerance
15.1 Demanding, offering, agreeing to give or take, or negotiating dowry in any form is prohibited on this Platform. This includes cash, gold, jewellery, property, vehicles, household goods, “gifts”, the funding of a wedding, or any expectation of payment expressed as a condition of a marriage proposal, whether raised by a Member or by a Member’s family.
15.2 Giving, taking or demanding dowry is an offence under the Dowry Prohibition Act, 1961 and the Bharatiya Nyaya Sanhita, 2023.
15.3 No field on the Platform asks about dowry, and no Member may use profile fields, notes, messages or the Community to signal such an expectation.
15.4 Where we find credible evidence of a dowry demand, we will close the account permanently, without refund, and we may report the matter to the police and to the Dowry Prohibition Officer of the relevant State.
15.5 If a dowry demand is made to you, please report it to us at safety@myhumdum.com. We will keep your report confidential to the extent the law allows.
16. Safety, fraud and scams
16.1 Genuine Members do not ask for money. Any request for money, however plausible or emotional the reason, should be treated as fraud and reported.
16.2 Be alert to these common patterns:
- A person who moves quickly to WhatsApp or another app, declares strong feelings early, and avoids video calls.
- A sudden medical, travel, visa or family emergency requiring an urgent transfer.
- A parcel, gift or foreign currency held by “customs” requiring a clearance fee.
- An investment, trading, cryptocurrency or “guaranteed return” opportunity introduced by a match.
- Someone who claims to be posted abroad, in the armed forces, or on an oil rig, and cannot meet or video call.
- Video calls recorded and used for blackmail, and threats to send images to your family.
- Someone impersonating our staff and asking for payment outside the Platform or for your password or one time password.
16.3 Never share a one time password, bank account details, card numbers, your Aadhaar number, your PAN or your passwords with another Member. We will never ask for these.
16.4 Before meeting, complete a video call, meet in a public place, arrange your own travel, and tell someone you trust where you are going and when you expect to return.
16.5 Report any concern to us at safety@myhumdum.com. You may also report cyber financial fraud to the National Cyber Crime Reporting Portal at cybercrime.gov.in or by calling 1930, and you may file a police complaint.
16.6 We do not conduct criminal record checks on Members unless we have expressly said so on a specific profile or feature. Absence of a warning does not mean a person has been screened for criminal history.
16.7 Our Safety Guidelines at www.myhumdum.com/safety form part of these Terms and say more about all of this. Please read them.
17. The Community
17.1 The Community is a moderated, quiet space for Members to write about the search for a partner and the life around it. The rules that apply to it are set out at Annexure B and form part of these Terms.
18. Communications from us
18.1 Service communications, such as verification codes, request and message notifications, payment receipts, safety notices and changes to these Terms, are part of the Service. You cannot opt out of them while your account is active.
18.2 Marketing communications require your separate consent and every one of them carries a one click unsubscribe. Unsubscribing from marketing does not affect service communications.
18.3 We will not override your registration on the Do Not Disturb register or the National Customer Preference Register, and we will not make outbound sales or telemarketing calls to you. This is a deliberate commitment and not merely a legal minimum.
18.4 We may communicate by email, in app notification, SMS, and, where you have opted in, WhatsApp.
19. Your Content and the licence you give us
19.1 You own the Content you create. Nothing in these Terms transfers ownership of your Content to us.
19.2 You grant us a non exclusive, worldwide, royalty free licence to host, store, back up, reproduce, resize, reformat and display your Content, solely in order to operate, secure, support and improve the Services and to show your profile to other Members in accordance with your privacy settings.
19.3 This licence is limited to running the Platform. It ends when you delete the Content or your account, subject only to backup copies which are overwritten within 30 days and to Content we are legally required to retain.
19.4 We will not use your photographs, name or profile in advertising, on our website, in social media, in press coverage or in any promotional material without your separate, specific, written consent, which you may withdraw at any time.
19.5 You are responsible for the Content you post. You confirm that you have the right to post it and that it does not infringe anyone’s rights.
19.6 If you send us feedback, ideas or suggestions about the Platform, we may use them without any obligation to you, and you agree that we may do so. This applies to product feedback only and not to your personal Content.
20. Our intellectual property
20.1 The Platform, its design, text, graphics, the swan device, the name My Humdum, our other marks, our matching methodology, our verification process, our scores and all software are owned by us or licensed to us, and are protected by copyright, trade mark and other laws.
20.2 We grant you a limited, personal, non exclusive, non transferable, revocable licence to access and use the Platform for the sole purpose of seeking a matrimonial alliance for yourself. All other rights are reserved.
20.3 You must not copy, reproduce, republish, frame, mirror, sell, licence, distribute, publicly display or create derivative works from the Platform or its Content, or use it to build a competing product or dataset.
20.4 This licence terminates automatically if you breach these Terms or if your account is closed. On termination you must stop using the Platform and destroy any material you downloaded from it.
21. Reporting, moderation and review
21.1 Every profile, message and Community post carries a report option. You can also write to safety@myhumdum.com.
21.2 We acknowledge reports within 24 hours. We aim to resolve ordinary reports within 72 hours. Reports involving an immediate risk to safety, child sexual abuse or exploitation material, threats of violence, or non consensual intimate imagery are actioned on priority, and non consensual intimate imagery is removed within 24 hours as required by Rule 3(2)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
21.3 Depending on what we find, we may take no action, issue a warning, remove Content, restrict a feature, suspend the account, or close it permanently. We aim to act proportionately.
21.4 Internal review. If we restrict, suspend or close your account, you may ask us once, within 30 days, to review that decision, by writing to support@myhumdum.com. The review is carried out by a person who did not take the original decision, and we will tell you the outcome within 15 days. Our decision on review is final. We are not obliged to disclose the evidence, the identity of a complainant, or our internal reasoning, particularly where doing so would compromise an investigation, expose a complainant, or assist a person in evading enforcement. Where we consider it safe and appropriate, we will tell you which rule was breached. Nothing in this clause affects your right to raise a grievance under clause 29.
21.5 We will confirm to a person who reports a Member that we have reviewed and acted on the report, but we will not disclose what action we took in respect of another Member’s account.
21.6 We may monitor, screen or review Content and account activity, but we are not obliged to do so, and our not having detected something is not a waiver of any right and does not create a duty to detect it in future.
22. Suspension and termination
22.1 You may close your account at any time from your settings, or by writing to support@myhumdum.com.
22.2 We may suspend or close your account where you breach these Terms, where we have reasonable grounds to believe you have provided false information or forged documents, where your conduct puts another Member at risk, where payment fails or is reversed, where we are required to do so by law or a court, or where a free account has been inactive for 24 consecutive months and you have not responded to a notice from us.
22.3 Where we close an account for breach, no refund is payable. Where we close an account for reasons unconnected with any fault on your part, we refund the unused portion of any paid Membership, calculated as set out in Annexure A.
22.4 Where we permanently discontinue the Platform, we will give at least 30 days’ notice to Members holding an active account. A Member holding an active paid Membership at that time will be refunded the unused portion of the Membership fee, calculated as set out in Annexure A, and this is the Member’s sole and exclusive remedy in the event of discontinuation.
22.5 Clauses which by their nature are intended to survive termination, including clauses 12.6, 14, 19, 20, 26, 27, 28, 29, 31 and 32, survive the closure of your account.
23. Data protection
23.1 We process personal data in accordance with the Digital Personal Data Protection Act, 2023, the Information Technology Act, 2000 and the rules made under it, and our Privacy Policy at www.myhumdum.com/privacy, which sets out in full what we collect, why, how long we keep it, who we share it with and what rights you have.
23.2 Your consent is taken separately, in response to a standalone notice. Before we collect your personal data at registration we present you with a notice, understandable independently of these Terms, that sets out in itemised form the personal data we collect, the purpose of each item, how to withdraw your consent, how to exercise your rights, and how to complain to the Data Protection Board of India. We record each consent, the version of the notice, the date, the time and the IP address.
23.3 You may withdraw your consent at any time, as easily as you gave it. Because the Services cannot be provided without processing your account, profile and verification data, withdrawal of consent for those purposes will mean closing your account, and we will tell you so before we act. Withdrawal does not affect processing carried out before the withdrawal, or data we must retain by law or to defend a legal claim.
23.4 As a Data Principal you have the right to access a summary of your personal data and of our processing, to correct, complete or update inaccurate data, to have your data erased, to nominate another person to exercise your rights in the event of your death or incapacity, and to a readily available means of grievance redressal. Write to privacy@myhumdum.com.
23.5 Your duties. Section 15 of the Digital Personal Data Protection Act, 2023 requires you not to impersonate another person, not to suppress material information, not to register a false or frivolous grievance, and to furnish only verifiably authentic information. A breach of those duties is punishable with a penalty of up to Rupees 10,000 under the Act, and is also a breach of these Terms.
23.6 We do not knowingly process the personal data of any person below 18 years of age, and no person below the minimum age in clause 4.2 may register.
23.7 We retain personal data only for as long as necessary for the purposes described in our Privacy Policy, and we delete or anonymise it thereafter, subject to any legal retention requirement, including the requirement to retain certain records for 180 days after the withdrawal or cancellation of a registration under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
23.8 If a personal data breach occurs, we will intimate affected Members without delay and notify the Data Protection Board of India as required by law.
23.9 Where we transfer data outside India, we do so only to the extent permitted under applicable law and with appropriate safeguards.
24. Child safety and protection of minors
24.1 This Platform is for adults only. No person below the minimum age in clause 4.2 may register. We may ask for proof of age at any time and will suspend or close any account where we cannot establish that the Member meets the age requirement.
24.2 We have zero tolerance for child sexual abuse and exploitation. Any content that depicts, describes, promotes or facilitates the sexual exploitation or abuse of a child is prohibited, and we act on it immediately.
24.3 You must not upload photographs of children, solicit information about a child, attempt to contact a minor, or engage in grooming behaviour of any kind.
24.4 We use automated detection and human review to identify such material. Where it is found, we remove it, preserve the evidence, close the account permanently, and report the matter to the police and to the relevant authorities, including under the Protection of Children from Sexual Offences Act, 2012 and the Information Technology Act, 2000. We cooperate fully with law enforcement in India and, where applicable, abroad.
24.5 Report any child safety concern immediately to safety@myhumdum.com. You may also contact the National Commission for Protection of Child Rights, the Childline helpline on 1098, the National Cyber Crime Reporting Portal at cybercrime.gov.in, or your local police station.
24.6 This clause is reviewed periodically and updated to remain consistent with applicable law and with the child safety requirements of any application distribution platform we may use in future.
25. Cooperation with law enforcement
25.1 We cooperate with the police, cyber crime investigation cells, courts and other statutory authorities in investigating fraud, harassment and other unlawful activity on the Platform.
25.2 On a lawful order or a valid request from an authorised agency, we will provide information in our control within the time prescribed under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and we will preserve information for as long as required for the purposes of an investigation.
25.3 Where the law permits us to do so, we will inform the affected Member that their information has been requested.
25.4 To report fraud or misuse to us, write to safety@myhumdum.com with full details, including profile identifiers, dates and any evidence you hold.
26. Intermediary status and disclaimers
26.1 We are an intermediary within the meaning of Section 2(1)(w) of the Information Technology Act, 2000. We do not initiate the transmission of Member Content, select the receiver of it, or modify the information contained in it, and we claim the protection available under Section 79 of that Act.
26.2 The Platform and the Services are provided on an “as is” and “as available” basis. To the extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non infringement, and uninterrupted or error free operation.
26.3 We are not responsible for the identity, intentions, honesty, character, conduct, health, finances, family circumstances, marital history or behaviour of any Member, whether on the Platform, in messages, on a call, in person, or after the two of you have moved off the Platform.
26.4 The great majority of the Content on the Platform is created by Members, not by us. We take the precautions described in these Terms and in our Safety Guidelines, and we verify identity and such further categories as we expressly state on a profile. We do not, and cannot, verify the truth of every statement a Member makes. We do not accept any legal responsibility or risk arising from information that is wrong, inaccurate, incomplete, out of date or misleading and that has been presented by any Member, nor for any decision you take, or refrain from taking, on the basis of it.
26.5 We are not a party to, and accept no responsibility for, any relationship, engagement, marriage, breakdown of a marriage, financial arrangement, or dispute between Members or their families, whether it began on the Platform or elsewhere.
26.6 Match Scores, Kundali indications, introductions and search results are informational. They are not advice and must not be relied on as the basis for any decision.
26.7 Once a conversation moves off the Platform, to another application, to a telephone call, or to a meeting in person, we can neither observe it nor protect it.
26.8 Nothing on the Platform, including in the Community or in any communication from us, constitutes legal, financial, tax, medical, psychological, astrological or professional advice.
26.9 We are not responsible for interruptions, delays, data loss, transmission failures or security incidents caused by telecommunication networks, internet service providers, devices, third party software, payment gateways or events beyond our reasonable control.
26.10 Any third party website or service linked from the Platform is provided for convenience only. We do not endorse it and we are not responsible for its content or its handling of your data. Where you have yourself placed information in the public domain and a third party finds and misuses it, that misuse is not attributable to us.
26.11 Nothing in this clause limits any liability that cannot be limited under applicable law.
27. Limitation of liability
27.1 To the extent permitted by law, we, our directors, officers, employees, agents and service providers are not liable for any indirect, incidental, special, consequential, exemplary or punitive loss, including loss of profit, loss of opportunity, loss of data, loss of goodwill, emotional distress or reputational harm, arising out of or in connection with the Platform, the Services or these Terms, even if we were advised of the possibility of such loss.
27.2 Our total aggregate liability for all claims arising out of or in connection with these Terms, the Platform or the Services, whether in contract, tort, statute or otherwise, is limited to the total amount you actually paid to us in the twelve months immediately preceding the event giving rise to the claim. Where you hold a Free Membership and have paid us nothing, our total aggregate liability is limited to Indian Rupees 2,500.
27.3 Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by our negligence, or any liability that cannot lawfully be excluded, including rights available to you as a consumer under the Consumer Protection Act, 2019.
28. Indemnity
28.1 You agree to indemnify and hold harmless My Humdum, its affiliates, directors, officers, employees, agents and service providers against all claims, demands, proceedings, losses, damages, costs and reasonable legal fees arising out of or in connection with (i) your use of the Platform in breach of these Terms, (ii) your breach of any representation, warranty or undertaking in these Terms, (iii) Content you posted, or (iv) your fraud, wilful misconduct or violation of any law or of any third party’s rights.
28.2 We will notify you of any claim for which we seek indemnity, and we will not settle any such claim in a way that imposes an obligation on you without your consent, which you must not unreasonably withhold.
29. Grievance redressal
